TERMS AND CONDITIONS FOR BOUTIQUE AND ORDER SALES

Definitions

"Buyer" means the person purchasing any of Nourbel Le Cavelier goods.

"Nourbel Le Cavelier" means Nourbel Le Cavelier Limited.

"Personalised Jewellery" means any items of jewellery that is created or altered by Nourbel Le Cavelier in accordance with the Buyer's specifications (this includes but is not limited to items with customised design).

"Website" means the website at http://www.nourbel-lecavelier.com/

Basis of Contract

  • These Conditions apply to the contract to the exclusion of any other terms that the Buyer seeks to impose or incorporate, or which are implied by trade, custom, practice or course of dealing.
  • The buyer's order for the goods as set out overleaf ("order") constitutes an offer by the buyer to purchase the goods in accordance with these Conditions. The buyer is responsible for ensuring that the terms of the order and any applicable specification relating to Personalised Jewellery is complete and accurate at the time of submitting the order to Nourbel Le Cavelier.
  • The contract shall come into existence strictly upon the Buyer's payment in full being received by Nourbel Le Cavelier.
  • Any samples, drawings, descriptive matter, or advertising produced by the Nourbel Le Cavelier and any descriptions or illustrations contained in the Nourbel Le Cavelier's catalogues, brochures or Website are produced for the sole purpose of giving an approximate idea of the goods described in them. They shall not form part of the contract or have any contractual force.

Payment and Delivery

  • Risk in the goods will pass to the Buyer on collection or despatch, title in the goods will not pass to the Buyer until payment is received in full.
  • The price of the goods is inclusive of amounts in respect of value added tax (VAT), unless otherwise stated.
  • Delivery, carriage and insurance costs are the responsibility of the Buyer, and are payable at the time of purchase or of placing the order. Any transportation arranged on behalf the Buyer in relation to the goods is at the sole risk of the Buyer. The Buyer is advised to insure.

Returning Goods

  • Unless the goods are faulty, Personalised Jewellery cannot be returned or exchanged for a credit note.
  • Where a Buyer has ordered a ring re-sizing, Nourbel Le Cavelier may, at its sole discretion, decide to provide a credit note in exchange for the ring. For the avoidance of doubt, the ring must have been purchased by the Buyer in a Nourbel Le Cavelier store.
  • Subject to 8 above, goods in original and unaltered condition may be returned for exchange for a credit note within 7 days of purchase and must be accompanied by the original sales invoice. Credit notes issued on exchange must be used within twelve months of being issued.
  • Refunds will only be given against goods which are faulty, and will be subject to proof of purchase; any such refunds will be by the same means of payment as used for the original purchase.

Intellectual Property Rights

  • Copyright, trademarks, and other intellectual property rights in all materials or content contained in NOURBEL & Le Cavelier's catalogues, brochures or Website, are owned by Nourbel Le Cavelier.
  • The Buyer may not do any of the following:

    1. copy, reproduce, distribute, republish, download, display, post, transmit, commercially exploit or create derivative works of any part of NOURBEL & Le Cavelier's catalogues, brochures or Website. This prohibition applies, but is not limited, to any photographs, sketches, models and other forms of reproduction whether in 'faux bijoux' (or any other medium ext), graphics, animations, pictures, data, images, audio and video clips available from the catalogues, brochures or Website;
    2. download, edit, reproduce or use any material and content contained within the catalogues, brochures or Website for the purpose of publicity, advertising, promoting, or for any other commercial purposes; or
    3. create and/or publish its own database that features substantial parts of the catalogues, brochures or Website (including without limitation prices and product listings).

  • The Buyer may print off one copy, and may download extracts, of any page(s) from the Website for its own personal reference and the buyer may draw the attention of others to material posted on the Website.

Our Liability

  • Nothing in these Conditions shall limit or exclude Nourbel Le Cavelier's liability for:

    1. death or personal injury caused by its negligence, or the negligence of its employees, agents or subcontractors (as applicable);
    2. fraud or fraudulent misrepresentation;
    3. breach of the terms implied by section 12 of the Sale of Goods Act 1979;
    4. defective products under the Consumer Protection Act 1987; or
    5. any matter in respect of which it would be unlawful for Nourbel Le Cavelier to exclude or restrict liability.

  • Nourbel Le Cavelier shall under no circumstances whatever be liable to the Buyer, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss of profit, loss of business, loss of savings, or any indirect, special, economic or consequential loss arising under or in connection with the contract.
  • Nourbel Le Cavelier's total liability to the buyer in respect of all other losses arising under or in connection with the contract, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no circumstances exceed the price of the goods.

General

  • No failure or delay by a party to exercise any right or remedy provided under this agreement or by law shall constitute a waiver of that or any other right or remedy, nor shall it preclude or restrict the further exercise of that or any other right or remedy. No single or partial exercise of such right or remedy shall preclude or restrict the further exercise of that or any other right or remedy.
  • The contract constitutes the entire agreement between the parties. The Buyer acknowledges that it has not relied on any statement, promise or representation made or given by or on behalf of Nourbel Le Cavelier which is not set out in the contract. Nothing in this sub-clause shall limit or exclude any liability for fraud.
  • The rights and remedies provided under this contract are in addition to, and not exclusive of, any rights or remedies provided by law.
  • If a provision of this contract (or part of any provision) is found by any court or other authority of competent jurisdiction to be invalid, illegal or unenforceable, that provision or part-provision shall, to the extent required, be deemed not to form part of this contract, and the validity and enforceability of the other provisions of this contract shall not be affected. If a provision of this contract (or part of any provision) is found illegal, invalid or unenforceable, the provision shall apply with the minimum modification necessary to make it legal, valid and enforceable.
  • A person who is not a party to this contract shall not have any rights under or in connection with it.
  • Nourbel Le Cavelier may assign any benefit or transfer, delegate or sub-contract any of its duties or obligations under this contract.
  • This contract shall be governed by and construed in accordance with the laws of England and the parties submit to the exclusive jurisdiction of the English courts.
